INFORMATION ABOUT
YOUR LAND & SEA VACATION
eDiscovery Vacation offers you access and use of Carnival Cruise Lines®,
Fairfield FairShare Plus and LeisurePlan programs during the membership
period. An individual becomes a member of eDiscovery Vacations upon receipt
of the completed Membership and user fees, subject to the following
terms and conditions:
1. Membership. Membership in eDiscovery Vacations is available to individuals and
their immediate families only. Membership in eDiscovery Vacations is
nontransferable and may not be sold.
2. Personal
Expenses and Damages. Members are responsible for payment of any
personal expenses incurred while utilizing any eDiscovery Vacations
program or benefit. Fairfield, its subsidiaries, their advertising agencies,
printers and other suppliers, as well as its officers, directors, employees
and agents will not be liable for any injury, liability, expense, damage
or loss incurred by a member or any accompanying family member or guest
during any trip or utilization of any eDiscovery Vacations program or
benefit nor any damage, theft or loss caused or incurred by the member,
their family or guest.
3. Membership
Suspension and Termination. This contract, together with member
status, may be suspended or terminated by Fairfield without further
obligation if the member fails to comply with these terms and conditions
or the terms of the various programs and benefits of eDiscovery Vacations.
4. Program
Procedures and Changes. Members are responsible for following the
procedures and guidelines for eDiscovery Vacations as described in the
Member's Directory. The terms and conditions of this Agreement and of
the eDiscovery Vacations programs and benefits may be changed from time
to time as the sole discretion of Fairfield. Members shall be notified
of any information regarding such changes.
5. Miscellaneous. This agreement is effective when accepted by the eDiscovery Vacations
representative and shall be governed, construed and enforced exclusively
in accordance with the laws and in the courts of the State of Florida.
6. Effect
of Termination. Cancellation of membership in eDiscovery Vacations
shall in no way relieve a member of his or her obligation under any
other contract or agreement with Fairfield.
7. All
benefits, programs, fees and costs of Carnival Cruise Lines® and
LeisurePlan (if included) are subject to change and to the individual
terms and conditions of the independent suppliers of particular Carnival
Cruise Lines® and LeisurePlan benefits or programs.
8. Buyer
may cancel this contract at any time prior to midnight of the seventh
day after receipt of this membership enrollment or as otherwise required
by law. To cancel, you must notify the sales location where you purchased
in writing of your intent to cancel and all membership materials must
be shipped back in good condition.
7. Land
& Sea Cruise Option. For eDiscovery members who choose to exercise
the Land & Sea cruise option, the following will apply:

Land
& Sea option will allow two(2) persons to travel together in
the same one-bedroom suite and same cruise cabin. Members shall
be responsible for port fees, government fees and taxes (approximately
$99 per person on featured Land & Sea option). Up to two (2)
additional persons (maximum of four (4) persons per cabin) may travel
for an additional fee, subject to availability of accommodating
cabin. Members are required to consult cruise counselors for the
current additional person charges when making reservations To ensure
the best selection, reservations should be made well in advance,
up to 10 months prior to the desired sailing date. |

Member
must reserve four (4)-night condominium stay in Orlando, Fort Lauderdale
or Daytona Beach, Florida, immediately prior to three (3)-night
cruise. Member may not take cruise portion of vacation separate
from condominium stay. |

c. |
Members
who wish to choose upgraded room or cabin accommodations or reverse
their itinerary and travel 3 nights land accommodation and 4 nights
cruise may choose to do so for an additional cost to member. Cost
will vary by type of accommodation, day of check-in and date of
sailing. Please check with your cruise counselor for your specific
charge. |

All
requests for changes, such as change of name, must be submitted
in writing via certified mail*. Notices received 60 to 46 days prior
to scheduled arrival date will be charged a minimum of $100.00 per
person. Notices received 45 to 8 days prior will be charged a minimum
of $150.00 per person. Some changes, such as change of sailing date,
can require a complete cancellation and loss of points used to book
the original reservation. Any changes 60 days or less will result
in a complete forfeiture of points used for booking the Land &
Sea vacation. Canceled Reservation and/or Limited Account Points
do not apply to Land & Sea reservations. Fairfield recommends
the purchase of trip cancellation insurance. |

Proper
travel documentation is required throughout the cruise and is the
responsibility of the member. Any member or guest traveling without
prior documentation will not be allowed to board the vessel. Cruise
counselors will advise members regarding specific requirements. |

f. |
Carnival
reserves the right to cancel or substitute any scheduled port of
call at any time for any reason whatsoever without prior notice,
and shall not be held liable for any loss to members by reason of
such cancellation or substitution. Reservations are subject to change
in the event of a full-ship charter. |

g. |
Travel
not valid on major holidays and a full 3 days before or after a
major holiday. (Major holidays: New Year's Day, President's Day
weekend, Easter, Memorial Day, Independence Day, Labor Day Weekend,
Columbus Day, Thanksgiving Day & Christmas). |

To Do When You're Ready To Go
After you have planned the details of the vacation you'd like to
take, call eDiscovery Vacations Reservations at 1-800-251-8736, Dept.
42. The Reservation Center is open Monday - Friday 8:00 a.m. to 8:00
p.m. and Saturday from 9:00 a.m. to 6:00 p.m., EST, except for major
holidays. If you prefer, you can use the Reservation Request Form to
fax or mail in your request. When your reservation has been confirmed,
your will receive a written confirmation.
